UMARA POLICY REGARDING USE AND/OR POSSESSION OF ILLEGAL DRUGS OR SUBSTANCES
AND ALCOHOLIC BEVERAGES.
ALCOHOL
1. Any participant found to have consumed or be under the influence
of alcoholic beverages during a UMARA competition event will be evicted
from the racing facility, denied further entry to the facility, and
may be suspended for a period to be determined by UMARA Officials
not to exceed one (1) year.
DRUGS
2. Illegal Drugs Definition: Illegal drugs are those substances
defined and prohibited by state/or federal laws.
3. General Prohibition: Possession or use of illegal drugs or substances,
as defined above, is prohibited in any form, by any participant
of UMARA, either on the racing facility, or in any area considered
to
be used in the operation of the racing facility, such as pits,
restrooms, concession areas, and parking lots.
4. Participant definition. A participant is any person taking
part in any UMARA competition event in any form, including
but not restricted
to, drivers, car owners, mechanics, crewmembers, sponsors,
track officials, or pit area observers.
5. Violations and Penalties. Any participant found to be in
possession of or under the influence of an illegal drug or
drug substance
in the racing facility, as defined above,
a. Shall be suspended from competition and evicted from the
racing facility, and denied further entry to the racing facilities
for
a period to be determined by UMARA Officials.
b. May be subject to random and or periodic drug screening
tests for a period of time to be determined by UMARA. Any
failure or
refusal to submit to any test pursuant to this rule will
result in an immediate
suspension not to exceed one (1) year.
c. Any participant who is convicted by a court of law with
a felony illegal drug violation may be suspended from all
forms of participation
in UMARA events. It shall be the responsibility of the participant
to make notification to UMARA of the conviction prior to
the entering the next competition event. Failure to make
proper
and
timely notification
will result in an immediate suspension not to exceed one
(1) year. Any participant convicted of a felony drug charge
by
such a process
of law shall be entitled to a hearing by the UMARA board
to determine if any disciplinary action should be taken.
6. Appeals and Hearing. Any participant suspended for violation of
these rules may be granted an appeal hearing, provided the suspended
participant requests such a hearing in writing. within fourteen (14)
calendar days of the date of suspension. It is the responsibility of
the suspended party to make such a request, if a hearing is desired.
7. Reinstatement. A participant suspended for violation of these
rules, except in the case of being charged with the sale or
manufacturing
of drugs, may, after a hearing and at the sole discretion of UMARA
management, be re-instated, if the participant- at his/her own expense-
will produce documentation from a physician licensed within the State
of Jurisdiction, certifying that he/she is drug independent, as a
result of random and periodic examinations and urine tests,
made at the request
of UMARA Officials
.
8. Prescribed Drugs. The consumption of any prescription drug that
impairs the driver’s ability to safely operate a race vehicle
is prohibited. The driver may be excluded from competition for the
event only in which the drug influences the driver’s condition,
and no further penalties will be imposed.
9. Enforcement of Policy.
This policy shall be effective and in force on March 1, 2004.
Any non-compliance of this policy prior to March 1, 2004 shall
not be used nor considered for disciplinary against any UMARA
participant.
